The Small Print

Terms & Conditions – updated September 2022.

1. Once accepted, the owner is committed to being available to and for clients. Please feel free to message/phone/email at any time to discuss concerns or progress. Calls will always be returned when falling outside BESPOKEN business hours. This minimizes disruption to sessions.

2. Fees are payable up-front or monthly in advance when session by session, by course or before the 1st of each month. A course is defined as 3 or more sessions or a one-day delivery or more, as per a Purchase Order. Terms for training delivery is two weeks from the date of invoice.

3. Commitment to and engagement with the course is required. One month’s notice is requested for the intention to discontinue sessions. Each 6-week course must be completed within 3 months to ensure effectiveness. A Purchase Order shall be payable in its entirety once agreed and as work is delivered.

4. Sessions cancelled with less than 24 hours’ notice or not attended cannot be credited. Sessions are defined as 45-120 minute, 121 meetings. They can be taken F2F, via telephone, or remotely via video conferencing.

5. Disclaimer: While care is taken to ensure the safety of each person, Bespoken and its members and employees accept no responsibility or liability for any loss or injury whatsoever of any participants taking part in any class.

6. Your data is not stored online or shared and is used only for purposes of training and coaching of which you will be fully aware.

8. When supplying the Services to the Customer, the Service Provider may gain access to and/or acquire the ability to transfer, store or process Personal Data of employees of the Customer. 

9. The parties agree that where such processing of personal data takes place, the Customer shall be the ‘Data Controller’ and the Service Provider shall be the ‘Data Processor’ as defined in the General Data Protection Regulation GDPR as may be amended, extended and or re-enacted from time to time. 

10. For the avoidance of doubt ‘Personal Data’, ‘Processing’, ‘Data Controller’ ‘Data Processor’ and ‘Data Subject’ shall have the same meaning as in the GDPR. 

11. The Service Provider shall only Process Personal Data to the extent reasonably required to enable it to supply the Services as mentioned in these Terms of Business or as requested by and agreed with the Customer, shall not retain any Personal Data longer than necessary for the Processing and refrain from Processing any Personal Data for its own or for any third party’s purposes. 

12. The Service Provider shall not disclose Personal Data to any third parties other than employees, directors, agents, sub-contractors or advisers on a strict ‘need-to-know’ basis and only under the same (or more extensive) conditions are set out in these Terms of Business or to the extent required by applicable legislation and/or regulations. 

13. The Service Provider shall implement and maintain technical and organisational security measures as are required to protect Personal Data processed by the Service Provider and on behalf of the Customer.
